Terms & Conditions

1. Service

fralyck offers a monthly service of design, development, hosting and SEO for professional websites under a USD monthly subscription:

• Essential plan: $50/month — professional site with up to 6 sections.
• Ecommerce plan: $60/month — online store with catalog, cart and payment gateway.
• Custom plan: webapps, dashboards or integrations — fixed quote per project.

2. No upfront payment

No plan requires setup or upfront fee. You pay only the monthly fee from the first active service month. The first invoice is issued once the design proposal is approved.

3. Delivery times

• Essential plan: approximately 14 business days from design approval.
• Ecommerce plan: approximately 21 business days.
• Custom plan: defined in the project quote.

If delivery is delayed due to fralyck, that month is not invoiced. Delays caused by missing client information (text, images, access) are not attributable to fralyck.

4. Monthly changes

Each plan includes up to 5 changes per month at no additional cost. A "change" means any content, design or functionality modification requiring developer intervention.

Unused changes do not accumulate. Extra changes are quoted at an hourly rate.

5. Cancellation and service pause

You may cancel the subscription at any time, no lock-in, no penalty.

• Cancellation takes effect at the end of the paid monthly period.
• Upon cancellation, the site goes offline. Files and data are kept for 6 months in case you want to resume.
• If you resume within that window, the site is republished without reactivation fee.
• After 6 months without reactivation, data is permanently deleted.

6. Non-payment

If payment is not made by the due date, fralyck sends an email reminder. After 7 days without payment, the site is automatically paused until payment resumes. The site is not deleted: it is republished as soon as the debt is settled.

7. Intellectual property

• Client content (text, images, brand, product data): always owned by the client. fralyck only receives a license to use it within the site while the service is active.
• Domain: registered in the client's name from day one.
• Source code, design and technical architecture: owned by fralyck. The client does not receive source code upon cancellation. fralyck offers a managed service, not a software sale.
• Operational data (orders, customers, products): the client may request a standard export (CSV, JSON) at any time.

8. Hosting, domain and SSL

The monthly price includes hosting, SSL certificate and domain management for the duration of the active subscription. Domain cost (yearly renewal) is included while the plan remains active. If the client cancels, the domain can be transferred to another provider at any time.

9. SEO

fralyck guarantees the application of technical and on-page SEO best practices (semantic structure, schema.org, speed, sitemap, optimized content), but does not guarantee specific rankings on Google or any search engine, as rankings depend on factors outside fralyck's control.

10. Limitation of liability

fralyck is not responsible for:

• Loss of revenue or commercial opportunities derived from technical outages or search engine changes.
• Content provided by the client (legality, accuracy, copyright).
• Indirect, consequential or lost-profit damages.

fralyck's total liability for any claim is limited to the amount of the last monthly fee paid by the client.

11. Changes to terms

fralyck may update these terms to reflect legal or service changes. Changes are communicated by email at least 30 days in advance. If you disagree, you may cancel without penalty before they take effect.

12. Governing law

These terms are governed by the law of fralyck's home jurisdiction. Disputes will be attempted to be resolved amicably before resorting to competent courts.
